Carry out assignments entrusted by the Director of Legal Affairs to respond to requests from various departments and key partners on matters related to real estate brokerage, corporate law, contracts, the management of calls for tenders, access to information and compensation (FICI), governance and any related area.
Advise the Organization and its departments on any legal issue related to the Real Estate Brokerage Act and its regulations, administrative law and any operational matters such as drafting and negotiating contracts, validating agreements, etc.;
Advise and support various departments such as the Registries, the Corporate Secretariat, Certification, Training and others on legal matters and explain laws and their implications for the public, the Organization and license holders;
As counsel, participate in the Organization’s positions or interventions that have legal implications;
Draft memoranda, legal opinions, contracts and other legal documents;
Act as a trainer or speaker for OACIQ staff, license holders or the general public, notably on matters related to the Real Estate Brokerage Act and its regulations.
When required, act as a resource person on committees or working groups, including with other Canadian real estate brokerage regulators. Advise the Human Resources Department on labour law matters.
Provide legal opinions on labour and employment law issues, aligned with the organizational culture.
Actively participate in decision-making and the development of organizational policies related to labour relations.
Manage highly confidential legal files that have a direct impact on the organization.
Represent the employer exclusively in all collective bargaining negotiations.
When necessary, represent the organization as the employer in labour law matters before administrative tribunals (e.g., TAT, CNESST) and civil courts.
Provide legal advice to managers regarding disciplinary actions and performance management.
Draft and review HR policies, employment contracts, letters of agreement and other legal documents.
Monitor legal developments and recommend adjustments to internal practices.
Provide training, notably to managers, HR teams and legal teams.
Requirements
Bachelor of Laws (LL.B.) or Juris Doctor (J.D.);
8 to 10 years of relevant experience;
Member in good standing of the Quebec Bar (Barreau du Québec);
Up-to-date, in-depth knowledge of labour law;
Proven skills in conflict resolution and strategic communication;
Knowledge of administrative and professional law (an asset);
Knowledge of the Real Estate Brokerage Act in Quebec and its regulations (an asset);
Knowledge of the Act respecting access to documents held by public bodies and the protection of personal information (an asset);
Ability to work independently;
Excellent time and priority management;
Strong analytical and synthesis skills;
Strong interpersonal, writing and communication skills;
Team player with the ability to encourage collaboration.
