The attorney will be responsible for dispatching court publications, scheduling deadlines in the case management system, analyzing more complex cases, preparing reports, requesting obligations from the client, and meeting deadlines;
Must have experience drafting initial pleadings (payment order/monitory actions, enforcement/execution, collection), defenses, counterclaims, appeals (Recurso Inominado, Appeal, Motions for Clarification/Embargos de Declaração, Special Appeal
Recurso Especial (RESP), Extraordinary Appeal
Recurso Extraordinário (REXT), Internal Appeal/Agravo Interno, Interlocutory Appeals in RESP and REXT), simple pleadings and, primarily, more complex submissions;
Desirable expertise in banking and mass litigation — both plaintiff and defendant — drafting procedural documents, deadline control, and experience handling the actions listed below:
Bank as plaintiff (or Credit Recovery): Proficiency with Enforcement Actions, Objections to Enforcement (Embargos à Execução), Monitory Actions and Collection actions;
Bank as plaintiff (or Active Claims): Lease Renewal actions (Ação Renovatória de Locação), Rent Revision actions;
Bank as defendant (or defendant’s side): Rent Revision actions, Claims for Damages, Declaratory Actions, Accounting Actions, Precautionary/Interim Relief actions;
Experience conducting cases in the merits phase (trial/knowledge phase) and in enforcement of judgment or liquidation of judgment;
Responsible for responding to all client queries submitted via the internal system and e-mail;
Responsible for handling client requests submitted via spreadsheets;
Responsible for managing more complex cases and matters requiring urgent measures requested by the client;
Responsible for entering procedural information into the firm’s case management system;
Responsible for analyzing waiver of appeals (self-waiver/autodispensa de recursos);
Responsible for drafting all types of appeals and initial pleadings;
Responsible for requesting enforcement of obligations to act and to pay (motions to enforce performance and payment obligations);
Responsible for requesting supporting information and case-related inputs from the client.
Requirements
Minimum 3 years registered with the São Paulo Bar Association (OAB-SP) (registrations from other states will not be considered);
Experience in law firms, preferably in mass litigation practice;
Experience drafting defenses and appeals;
Basic knowledge of Microsoft Office (Word and Excel) and the Internet.
