About The Division:

The Human Resources Division supports the agency’s strategic direction by assisting management in meeting staffing needs and managing people. This includes recruiting and hiring staff; on-boarding new hires; coordinating benefits; training and developing the workforce on HR topics; creating and implementing employee engagement initiatives; and facilitating separation. Human Resources’ professionals are consultants and business partners; they advise managers and employees on workforce issues and help the agency achieve its business goals.

General Description:

Join Human Resources as a Human Resources Business Partner! Will perform Human Resources management work in a fast-paced, multi-project environment. Work involves providing coaching and guidance to managers related to employee performance and development. Successfully guides internal employees and management through the interactive process related to requests/needs for workplace accommodations. Gathers information, records, and data related to requests for accommodations, discipline, terminations, complaints, allegations of mistreatment, and policy violations. Communicates and partners with Workplace Investigator as identified. Ensures compliance with agency policy, state and federal laws and regulations relative to equal employment opportunity, Americans with Disabilities Act (ADA), ADA Amendments Act (ADAAA), Title VII of the Civil Rights Act of 1964, and other relevant laws. Writes, proofs, edits, and develops various reports, articles, timelines, and summaries related to Employee Relations matters. Serves as the agency’s Workplace Accommodations Coordinator, Employee Assistance Liaison (EAP), and Workers’ Compensation Claims Coordinator. Backups and supports the FMLA/Special Leave Coordinator and Investigator. Trains agency management and staff on employee relations-related topics as needed. Work requires exceptional working relationships with all levels of agency management and staff.

Monday through Friday, 40 hours a week with occasional evening, weekend hours and holidays. Hours may change based on business need.

This position may be eligible for a flexible/hybrid work schedule of 3 in office days and 2 remote workdays once certain conditions are met. Work schedules may change at any time as business necessitates.

Minimum Qualifications

·        Bachelor’s degree.

·        3 years of experience supporting employees and/or management in a human resources environment, performing complex employee relations matters.

·        Experience in reviewing, leading, advising on, and resolving sensitive employee concerns and investigations.

·        Experience with case management of FMLA, Workers’ compensation, special leave, and processing employee benefits.

·        Experience handling sensitive cases: disciplinary actions, terminations, policy violations.

·        Experience partnering with investigators, maintaining detailed documentation, and ensuring due process.

·        Experience ensuring compliance and interpreting HR policies in complex cases.

Preferred Qualifications

·        Bachelor’s degree in human resources management, business, psychology, public administration, or another related field.

·        Experience with Employment and HR-related laws, including Title VII.

·        Experience in Project Management methodologies.

·        Experience in designing and conducting employee relations training for managers and leaders.

Substitutions

·        One (1) additional year of experience performing complex human resources functions involving employee relations, employee dispute resolution and/or performance management may substitute for thirty semester hours of educational requirement with a maximum substitution of 120 semester hours (four years).

Licenses and Certifications

·        Preferred Certifications: PHR, SPHR, SHRM-CP or SHRM-SCP.

In this role you will:

Serves as the ADA-Workplace Accommodations Coordinator.

·        Maintains current knowledge of state and federal laws, regulations, and best practices related to disability rights and workplace accommodations.

·        Advises and consults with management and employees on accommodations; partners with Legal Counsel to support resolution of complex issues.

·        Meets with employees to discuss accommodation requests; reviews documentation and communicates determinations to relevant stakeholders.

·        Assists in developing and implementing internal measures and reports related to ADA compliance.

·        Develop, update, and maintain Standard Operating Procedures (SOP) for ADA and reasonable accommodation processes.

·        Maintains organized and complete records of all disability and accommodation requests and/or issues; completes timelines, summaries, and other related requests for complaints, terminations, and EEOC charges to Workplace Investigator, management, and/or Legal team.

·        Develop, prepare, and facilitate engaging and interactive training related to the ADA and workplace accommodation process to internal management as required and/or requested.

·        Review, analyze, and evaluate internal policies, procedures, and practices to identify the existence of discriminatory factors affecting persons with disabilities in the workforce.

·        Refer complaints lodged to the Workplace Investigator and management when allegations of discrimination and non-compliance under the ADA and other applicable federal and state laws regarding discrimination based on disability are identified. Work cooperatively when assistance, information, and support are needed related to allegations.

·        Provide routine guidance and training to other Employee Relations staff.

Oversees the agency's progressive disciplinary process, terminations, performance management, and performance appraisal programs.

·        Provide advice and recommendations to management and non-management staff.

·        Supports the use of performance measures to ensure effective operations.

·        Review performance evaluations that include any less than “meets” ratings and all probationary progress reports for policy compliance.

·        Provides performance management guidance to supervisors and managers (coaching, counseling, career development, disciplinary actions).

·        Review disciplinary actions, provide recommendations to management, and partner with Legal Counsel and Management for complex issues to ensure compliance and mitigate risk to the agency.

·        Prepares termination requests and provides guidance and recommendations to management.

·        Maintains organized and complete records for all disciplinary documents, logs and updates records in internal spreadsheets.

·        Interprets rules and regulations to counsel agency personnel and ensures compliance with agency policy and procedures and state and federal laws and regulations.

·        Works closely with legal, management, and employees to improve work relationships, build morale, and increase productivity and retention.

Serves as the agency’s backup FMLA /Special Leave Coordinator when business demands are needed and/or deemed appropriate for this position to perform.

·        Evaluates and reviews requests to determine eligibility for FMLA leave. Ensures compliance with agency policy, federal and state laws.

·        Provides written confirmation of FMLA eligibility and associated benefits.

·        Interprets FMLA rules and regulations for agency staff and regularly communicates with agency staff regarding the status of all FMLA requests.

·        Creates the FMLA record in the Centralized Accounting and Payroll/Personnel System (CAPPS).

·        Run reports from CAPPS to verify the accuracy of FMLA balances and proper coding in timesheets.

·        Works with the Employee Benefits section to ensure coordination of insurance benefits with associated leave requests. 

·        Responds to Open Records requests for FMLA and Special Leaves processed.

·        Reviews and administers special leave program requests to determine eligibility and present recommendations for Human Resources management approval.

·        Interprets agency policies for staff and presents recommendations for approval according to agency policies and state laws.

·        Reviews leave without pay (LWOP) submissions to ensure proper coding in the agency timekeeping system and leave protection under the FMLA.

·        Works closely with Payroll to reconcile timekeeping and FMLA coding errors.

Serves as backup to the Workplace Investigator on occasion, when business demands are needed and/or deemed as the most appropriate for this position to perform. 

·        Investigates complaints, allegations of mistreatment involving discrimination, sexual harassment, retaliation, or other potential discriminatory practices and/or policy violations.

·        Conduct investigative interviews of the complainant, respondent, witnesses, and other relevant parties to ensure a thorough, fair, and timely resolution.

·        Gather facts and review evidence from all sources to establish the extent and nature of the allegation. May review documents, reports, time and leave summary, employment history, and any other relevant data sources connected to the investigation.

·        Prepares a written investigation summary outlining the overview of the complaint, a summary of fact-finding, and recommended resolution for HR management and Legal Counsel review.

·        Works cooperatively between leadership, employees, and Legal Counsel, making recommendations for resolution, including corrective action.

·        Facilitates the timely resolution of complaints, grievances, and disputes brought by employees and management concerning the work environment; provides coaching and guidance to resolve employee disputes as needed.

·        Assist with the investigation and resolution of other workplace concerns to determine the appropriate approach and to ensure fair and consistent treatment of all employees.

·        Monitor and implement corrective action plans to enhance controls and processes.

·        Works closely with legal, management, and employees to improve work relationships, build morale, and increase productivity and retention.

Assist as the agency's Employee Assistance Program (EAP) and Ergonomics liaison.

·        Receives and reviews requests for approval of EAP leave.

·        Ensures compliance with agency policy and procedures. Determines applicable eligibility for requests.

·        Maintains the program’s logs, runs CAPPS queries when auditing is needed, and collaborates with the requestor or internal collaborators when needed.

·        Communicates approvals to internal employees and management and/or works to resolve or address issues with requestors.

·        Partner with a service provider, ComPsych and the State Office of Risk Management, for support/ training or escalations regarding an internal employee’s request.

Assist as the agency’s Workers' Compensation Claim Coordinator.

·        Responds to notices of workplace accidents or injuries. Completes investigations and associated paperwork to file a Worker’s Compensation claim.

·        Works with the Benefits department to coordinate applicable leave.

·        Administers the agency's return-to-work program under Workers’ Compensation.

·        Maintains related filing according to the agency records retention schedule.

·        Conducts HR policy training for agency management.

·        Partner with insurance provider, State Office of Risk Management (SORM), for questions, guidance, training, and escalations.
